Privacy Statement

It is our policy to protect the privacy of all users. To prevent unauthorized access, maintain data accuracy and ensure the appropriate use of information, FBCL has established physical, electronic and managerial procedures to protect any information collected online. Personal information collected by FBCL in the course of its authorized programs and activities is protected under the Privacy Act, R.S.C. 1985, c. P‑21.

This information is collected to administer FBCL programs and services, including communicating with registered users, and is accessed only by authorized personnel or service providers acting on FBCL’s behalf. However, as personal information sent via the Internet may be intercepted, registrants may opt to provide sensitive personal information to FBCL by regular mail.

Legal Authority

In order to collect personal information, section 4 of the Privacy Act requires that federal institutions and Crowns have legal authority for the program or activity under which the collection is to take place. FBCL collects personal information only where it has legal authority under section 4 of the Privacy Act and where the collection is directly related to and necessary for its mandated programs or activities.

What information does FBCL collect?

FBCL collects information from users when they register for services on the site, such as but not necessarily limited to opening a prepaid payment account, responding to a survey, or filling out a form.
When registering on the FBCL website, users may be asked to provide information such as their name, email address, mailing address, telephone number, vehicle information, or payment information. Users may, however, visit the site anonymously if not registering for an account.

Internet Protocol (IP) address may be captured in firewall and webserver logs and is part of the comprehensive security and threat mitigation processes used by FBCL to identify potentially malicious attackers. IP addresses are used for security, operational monitoring, and threat mitigation purposes and are not combined with other identifiable web analytics data for profiling or marketing.

Personal Information Bank: Traveler Accounts

Description: This bank describes information related to the registration, management and administration of the FBCL’s frequent traveler, loyalty and prepaid toll programs. Personal information collected by the FBCL in relation to the administration of transponder tags is limited to: account number, account password, vehicle information and tag identifier, name, mailing and shipping address, email address, telephone number(s), payment method, and correspondence.

Class of Individuals: This bank applies to individuals who apply for the FBCL’s frequent traveler, loyalty and prepaid toll program (ConneXion) and who hold active prepaid or loyalty accounts.

Purpose: Personal information described in this bank is used to administer the FBCL’s frequent traveler, loyalty and prepaid toll programs. Personal information is collected pursuant to the Financial Administration Act (FAA). The FBCL is a Crown corporation listed under Schedule III-I of the FAA.

Consistent Uses: Transponder tags information may be used internally for purposes of program administration and evaluation. This includes the resolution of program or toll disputes. Select personal information may be shared with authorized service providers and program partners, including system providers and third‑party payment processors, strictly for the purpose of delivering FBCL services. Aggregate toll and transponder tags information may be shared for internal research, evaluation and program procedures and processes purposes. Aggregate financial information may be used for budgeting and financial planning purposes.

Retention and Disposal Standards: Personal information collected by FBCL for the registration and administration of transponder tags will be retained for a minimum of two (2) years following the registration of an account, and for up to seven (7) years following the last recorded action (user based or administrative) taken in relation to a closed account.

How do we collect information?

FBCL may use web analytics services to understand how visitors interact with its website and to improve online services. That includes obtaining specific visitor cookie data, such as the source, medium and keywords used to visit the FBCL website. Web analytics services collect information in an aggregated and non‑identifying manner, and FBCL does not use analytics data to identify individual visitors.

The use of cookies

Cookies are small files that a site or its service provider transfers to users’ computer hard drive through their Web browser (when configured to allow it) that enables the site’s or service provider’s systems to recognize that browser and capture and remember certain information.

FBCL uses cookies to save user preferences for future visits and to compile aggregate data about site traffic and site interaction so that better site experiences and services may be offered in the future. FBCL may engage third‑party service providers to support website analytics and functionality, subject to contractual privacy and security safeguards. These service providers are not permitted to use information collected on behalf of FBCL except to help improve FBCL services.

If preferred, users may choose to have their computer provide a warning each time a cookie is being sent, or users may choose to turn off all cookies via browser settings. Like most websites, if users disable the exchange of cookies, some FBCL web services may not function properly. However, users may purchase FBCL services by telephone or by contacting FBCL customer service.

How does FBCL use personal information?

Personal information collected by FBCL may be used for the following purposes:

  • To personalize user experiences (user information helps FBCL to better respond to their individual needs)

  • To improve the FBCL website (FBCL continually strives to improve website offerings based on the information and feedback received)

  • To improve customer service (user information helps FBCL to more effectively respond to customer service requests and support needs)

  • To administer an account, promotion, survey or other site feature

How does FBCL protect user information?

FBCL implements a variety of security measures to maintain the safety of user personal information when registered for an account or for any other reason. Information provided to FBCL is collected by using privacy-enhancing technologies, such as Secure Sockets Layer (SSL) interactions. This information is safeguarded through administrative, technical, and physical security controls and may be shared only with authorized service providers or partners under strict confidentiality obligations.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into payment gateway providers’ database. Access to sensitive payment information is restricted to authorized personnel and systems with a demonstrated business need.

Disclosure of Personal Information

FBCL does not sell or trade personal information. Personal information may be disclosed to authorized service providers, partners, or legal authorities where permitted or required by law. This does not include trusted third parties who assists FBCL in the operation of its website, conducting business, or delivering services, so long as those parties certify to keep this information confidential. FBCL may also release user information when it is believed that this release is appropriate to comply with the law, enforce site policies, or protect FBCL or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

In the event FBCL is presented with a production order from law enforcement agencies, the company could be forced to disclose personal information collected to run its services and programs. FBCL may disclose personal information to law enforcement or other authorities in accordance with applicable laws, including where there are reasonable grounds related to health, safety, or legal compliance.

A law enforcement agency is an organization that is engaged in policing or conducting investigations that could result in a trial or hearing where penalties may be imposed. Its primary role must be law enforcement. Other organizations that conduct investigations, such as insurance companies and private security firms, are not law enforcement agencies.

Occasionally, at FBCL’s discretion, FBCL may choose to offer online access to third party products or services. Products offered from third party sites have separate and independent privacy policies. FBCL is not responsible for the privacy practices or content of third‑party websites. Nonetheless, FBCL seeks to protect the integrity of its site and welcomes any feedback about any linked sites.

Right of Access and Corrections

As a federal Crown corporation, FBCL’s collection, use, disclosure and disposition of personal information is subject to the Privacy Act. That Act gives individuals the right to access and correct their personal information, and requires that FBCL deploy measures to protect personal information. Individuals have the right to access and request correction of their personal information and may submit complaints to the Office of the Privacy Commissioner of Canada regarding FBCL’s handling of personal information.
